  • Can H1B visa marked as Cancelled on passport be used again?

    Hi ,
I want to know if the H1B petition which was approved can be used or not? below is the details and timeline.

    1- In year 2007, I got H1B approved.
2- H1B visa was stamped on my Indian passport at USA embassy.
3- Employer who sponserd me the H1B didn't call me so i never used by H1B.
    3- In 2008 , I moved to Canada.
4- In 2008 , I applied for USA B1/B2 visa. USA embassy at Toronto issues me B1/B2 visa but put CANCELLED on my H1B visa stamp.
5- In 2014, I got Canadian Citizenship. I surrender my Indian passport and received Canadian passport

My question is - Is there any possibility that my old approved H1B petition documents gets transfer to any employer ?
H1B visa stamp was marked as Cancelled and was on my Indian passport.

Please advise if approved petition can be used to reissue H1B visa.
    Thanks,

    Thanks,
Your H1 is well past its expiry date. You need to go through the lottery to get a new H1.
Just an opinion; Not legal advice.
