Need some suggestion my cousinis currently with emplyer A with 140 approved (EB2) a year ago . she got an offer from employer B ,the position is qualified for only eb3 so employer B is advising they would wait until Priority date(2015) get closer and by then she will get promoted and file PERM in EB2. Her husband is on h4 EAD.
so the question is
1)Can her husband work on h4 EAD even after she moved to employer B . If PERM is not filed by employer B until couple of months then h4 dependent is not eligible for H4 -EAD for that period ? .
2) what if her employer A revokes the PERM , Can she retain the PD and will it impact H4 EAD beneficary .
3)If she moves to EB3 the PD will still be 2015 ?
4) Is it feasible to port from EB3 to EB2 ,any idea if it is possible or not ?
