Question on New H1B Visa after completion of 6 years period on H1B
Hey ,
I need to confirm the USCIS process of applying new H1B Visa after completion of 6 years period on H1B. Can somebody please answer my query for both the scenarios I mentioned below.
MY CASE:
Currently in USA
H1b Max out - 9th June 2018
Visa/I94 Expiry - 30th April 2018
Scenario -1
If I will plan to travel to India before 1st April , Am I eligible for H1B lottery of this year (April 2018)? or I cannot even nominate for this year until I complete the 1 year of cooling period.
Scenario -2
If I will plan to travel to India after 1st April 2018 (before 30th April) , Am I eligible for H1B lottery of 2019 year ? I got to that, there is a April to April Cycle. If I will go to India after 1st April I am not even eligible for 2019 h1b lottery and Can only apply in 2020. Is this the USCIS rule ?
