  • Wrong LCA Application for H1-B

I wanted to see if anyone got into this situation. My company filed an LCA under Graphic Designer, but I'm not a graphic designer. My role covers only 10% of graphic design skills. I'm an email marketing specialist which I do about 80% of a front-end coding.

I doubt the LCA application is correct here.

Does anyone know under which LCA category an email marketing specialist role fallback into LCA?

Also, will this LCA application cause an issue with the H1-B process?

    Thanks for the help!

I'm not a legal expert, but I can provide some general information that might be helpful. The Labor Condition Application (LCA) is typically filed by an employer seeking to hire foreign workers on an H-1B visa. The LCA specifies the job title, job duties, and prevailing wage for the position.

If you believe that the LCA filed by your company does not accurately reflect your job role and responsibilities, it's important to discuss this matter with your employer and the relevant immigration attorney. They will be able to provide guidance on whether the LCA needs to be amended or updated to accurately represent your specific role as an email marketing specialist.

As for the specific LCA category that an email marketing specialist may fall under, it can vary depending on the nature of the job responsibilities and requirements. It's best to consult with an immigration attorney who can review your specific situation and determine the most appropriate category for your role.

Regarding the potential impact on the H-1B process, any discrepancies or inaccuracies in the LCA could potentially raise issues during the visa application process. It's crucial to ensure that the LCA aligns with the actual job duties and requirements of the position. An immigration attorney will be able to provide guidance and help address any concerns you may have about the LCA application and its implications for the H-1B process.
