DL extension on basis of petition I am not working on

Hi,

I was working for employer A. I got two offers, from B and C. Both of them applied for Visa transfer/petition.
Company B's petition got approved and is still valid.
I have joined Company C on the basis of H1 receipt.

My driving license is expiring in a week.
Can I use B's petition to apply for DL extension, even though I am not working for him. I don't think DMV cares whether I am employed with B or C. the only thing they need is an approved petition in my name.
Also, if I do this, is it considered illegal.
