    Hi All,

    Hope you are having a great day!



    My case is as follows:


    H1B start date: Oct 1st, 2008

    I-140 approved in Oct, 2014

    6th year H1B expiry date: Nov 23th, 2014

    Company has agreed to file for extension but I got an opportunity to move to India in an executive role for the same company.

    Moved to India: Nov 14th, 2014.

    Because of moving to India, my H1B extension was not applied.



    Initial plan was to work for 2 years in India and move back to US on L1A visa as I am in an executive role. Now its been close to 3.5 years and this plan is not working out.

    My question is:

    If I find a role back in US, will I have to wait and apply for new H1B in April, 2019 or are there options of extending my old H1B visa now which expired in Nov, 2014.

    Could you please help me.

    You can use the existing H1B

    You can use existing H1B and you are not counted towards the new cap.
