  • What are the differences between the H-4, H-1B, H-2B and H-3 visas in the US?

    H-4 Family of H visas
Family members of the H-1B worker are admitted to the United States in the H-4 category. Qualifying family members include only the spouse and unmarried children under 21 years old. Family members are admitted for the same period for which the principal family member is admitted.

Family members may alternatively be admitted in other nonimmigrant categories for which they qualify, such as the F-1 category for children or spouses who will be students or the H-1B category for a spouse whose employer has also obtained approval of an H-1B petition to employ the spouse.

H-4 family members may undertake studies while remaining in the H-4 category. Family members cannot engage in any form of employment in the H-4 category, however. In order to work, family members must obtain USCIS permission through the approval of a change of status application to a nonimmigrant category permitting employment.

Since H4 visa holders are not allowed to work, they are not issued the Social Security Number. However, they get the tax ID called ITIN. ITIN form should be sent to the IRS address, that is separate from the tax return address. W-7 form should be filed at the time of filing tax returns to get ITIN.

H-4 visa holders are allowed to open bank accounts and hold driver?s license.
H-3: Trainee or Special Education visitor

To receive training, other than graduate medical or academic, that is not available in the trainee?s home country or practical training programs in the education of children with mental, physical, or emotional disabilities.
    H-1B: Person in Specialty Occupation

To work in a specialty occupation. Requires a higher education degree or its equivalent. Includes fashion models of distinguished merit and ability and government-to-government research and development, or co-production projects administered by the Department of Defense.

H-1B visas are available for various types of specialty occupations that require theoretical or technical expertise in specialized fields such as in IT, architecture, engineering, mathematics, science, and medicine. Any job could come under the H-1B visa requirement as long as it is a graduate level job.,
    H-2A: Temporary Agricultural Worker

For temporary or seasonal agricultural work. Limited to citizens or nationals of designated countries, with limited exceptions, if determined to be in the United States interest.

    H-2B: Temporary Non-agricultural Worker

For temporary or seasonal non- agricultural work. Limited to citizens or nationals of designated countries, with limited exceptions, if determined to be in the United States interest.
