  • Use of an approved H1B petition which was never stamped

    Hi All,

In 2016, my employer has filed for my petition and it got approved in April that year. It was valid until December 2017 but I never got the chance to go to US and got no stamping in my passport. Now that the petition got expired, I want to know if there is any benefit at all, having went through the above. I'm also changing companies next month.

    1. If my future employer wishes to send me to US, will I be subject to CAP again?
    2. If I wish to study in the US in future, will I be subject to CAP again, once I finish the studies?
    3. If any of the above is an yes, what documents should I have to keep, since I will be changing employers. I have the I129 petition document and the approval notice(Form I-797C).

    Any help would be appreciated.
