    Hi Team,

    My visa and I94 was expired in Dec 2017, and my extension was filed in Nov 2017 and I received RFE in Mar2018 and got the denial in Jun 21 2018.

    I had been in H1B in US only for 1 year 4months, now I am planning to re-file under H1B non-subjective cap.

    1) Since my extension was just denied few days back, is it advisable to reapply under non-subjective cap immediately or is there any cooling period for which we should wait.
    2) It is advisable to apply the H1B non subjective cap in premium processing mode.

    1. There is nothing called cooling period. You really need to look into why it was denied and see if that reason is still there.
