No I797 for H4 , required for H4EAD?

  • No I797 for H4 , required for H4EAD?

    HI All,

    I am planning to submit for my spouse's H4EAD.
    I see there is a document in the checklist which I dont have.
    I have my H1 I797 but my spouse does not have one since her visa was approved/stamped based on my H1 and I797 and while she was in India.
    Can someone please tell me if this is mandatory? or can I just send I94 and H4 visa as prove of her valid stay in USA?

    In addition to this, can anyone please tell me the answer "Place of your last arrival into the united states".
    My spouse's POE was in Abu Dhabi as she flew via Etihad airways.
    But she entered via NYC. I am guessing it should be NYC right?
    And what should be the "date of last arrival into the United states"?
    in I94 form online they mentioned 07/27 arrival AUH. But the USCIS person stamped as 07/28.

    and Part 2: "In care of Name" is it mandatory to fill?

    There is no such thing as a "petition" for H4. The only thing that an H4 has is their status given by their I-94.

    The place of arrive is Abu Dhabi.

    "in care of" is only if you are using someone else's address; then it would be "in care of" that person
