I am in interesting scenario.
> My I94 expired last month and I had my extension in process from a consulting company.
> I got a full time opportunity and they filed H1B with counselor process and got approval last week.
> I was/am planning to travel back to India this weekend for stamping to new employer.
But today I got my extension denied from current employer. As I was anyway leaving the country this weekend to get stamping for new employer this should not affect me in out of status.
Questions are - Does last action rule applies to my case? Is my new H1B petition with CP still valid wit new employer? Can I still go ahead and get the stamping done on H1B from new emploiyer?
I will be posting these question to my new employer's team as well, but wanted to see what fellow people have to say on immihelp portal!
