I have valid H1B VISA which is expiring on 31st Dec 2018. I travelled to USA in Feb 2018. Due to location change my employer filed H1B amendment on the date of my travel. I got RFE for my amendment on 20th July. My employer responded to RFE on 12th Oct 2018. In the mean time my project is over and I had to travel back to India in Sept 2018.
Now after returning back to India, I am working for different client and USA location will be different. Now my current client want me to travel. I have below questions on my case.
1) Is my amendment RFE has any significance now considering the fact that project, location and LCA no longer valid. Even if I travel my project, location and state will also be different.
2) If my amendment has any significance, then what if it gets rejected? What will be options for me?
3) Can my employer file my H1B extension using CAP exempt option without waiting for USCIS response for my RFE?
