  • H4 queriers==wife pregnant issue

    Dear Friends,

    I have booked the visa date for my wife on aug18th (chennai)
    I dont have the w2 since I came in US during last week of March.
    ON the visa interview date my wife will be in her 7th month of her pregnancy.
    I have following queriers:

    1. What is the document equivalent of W2 I should send to my wife?
    2. Since my wife is pregnant, will that be a reason for visa refusal ?
    3. Due to pregnancy what extra precautions should I take to get the H4 visa successfully.
    4. I am trying book airticket optimistically on Aug 25th. So before aug25th will my wife gets the passport if she is stamped.? or Could you suggest when should I book the air-ticket?

    Please help me to plan well.

      Answers
      1. Send your pay-stubs for the previous 3 months
      2. This is a risk you should be willing to take; the immigration rule quotes that women who are past the 26 weeks into their pregnancy may not be allowed to enter the country.
      3. Book your flight in a comfortable airlines with good foot space; since it is a very tiring 20+ hrs journey; and if possible reduce your hand baggage to 1 bag with the necessary documentation and currency.
      4. Airlines will not issue tickets to women who are past 28 weeks into their pregnancy.

        A. There is no equivalent of W2. You need to send all the paystubs.

        2. Since my wife is pregnant, will that be a reason for visa refusal ?
        A. There is a very high chance of visa refusal. (Refusal will not be directly related to your wife's pregnancy)

        3. Due to pregnancy what extra precautions should I take to get the H4 visa successfully.
        A. It is not worth sending your wife and putting her in trouble at this point in time.

        A. There is a high chance of airlines refusing your wife a ticket. Further at the port of entry, she is highly likely to be denied an entry.

          Thanks much for the info.

          I have enquired about the I-129 and LCA with my employer, and I got the following reply from them;

          "We do not have original I-129 and LCA. Both should be sent to USCIS when we file H1 visa. They do not send back these originals."

          But as per the vfs site we need to provide the I-129 and LCA for the H4 visa.
          Could anyone of you suggest me what to do?

            The employer is correct.............uSCIS would ahve the original I-129 ....all they could ahve is the copy

              I got the copy of my I-129 and LCA from my employer.

              After reading many forums.
              Guess I am bit confused.

              I dont have any W2 since i came here in the month of March this year.
              All I have is the pay slip for the past 5 months.. that too a xerox copy.

              I asked for the original copy of my pay slip., my employer told me that xerox copy of my pay slip is enough.

              Can anyone suggest/comment on this.

                  First of all I should thank each and everyone in this forum.
                  Special thanks to the members who have replied to my quieries.

                  My wife got the visa without any hassle and she has landed safely here in united states.

                  Following is the set of documents that I have produced. And they have appreciated the way I have arranged it. The VO just approved seeing the docs without asking any questions.


                  Set-I
                  ======

                  1. Passport ( inside that passport =>HDFC challan original + DD(2300) + one photograph )
                  2. Visa Interview appointment letter
                  3. DS-156
                  4. DS-157
                  5. I-979 ( my visa paper)
                  6. I-129
                  7. LCA
                  8. Pay stubs
                  9. Bank Statement.( recent pay from US)
                  10. Employer letter
                  11. Current company offer letter ( original )
                  12. Copy of my passport
                  13. Original Marriage certificate
                  14. Marriage invitation card
                  15. Marriage photos (minimum 40)
                  16. Xerox copy of my Driving license from US
                  17. Xerox copy of my SSN


                  Set-II
                  =======

                  1. Letter from the doctor fitness ceritificate ( that you can fly abroad fit to travel/
                  what week of pregnancy running )
                  2. Medical Insurance.(US original since pregnant eg., HPHC)
                  3. Travel itenary ticket copy
                  4. Car insurance letter
                  5. Photos of my work place.
                  6. Client letter original(dont show it unless asked)
                  7. xerox copy of my Health Insurance.


                  Set-III
                  =======

                  1. My experience letters.(offer + relieving letters of each previous companies)
                  2. My previous pay slips.
                  3. My original degree certificates.(10th till degree)
                  4. My previous bank statements. (all possible showing the salary credit )
                  5. your degree certificates and individual mark sheet. ( from 12th std )
