Hello all,
My spouse is working in the US based on her L2 visa (valid till May 2020) and EAD. Her employer is applying for an H-1B Change of Status this year. We had a few questions about travel and were wondering if you know the answers based on your experiences or knowledge:
Assuming her H-1B gets picked & approved and she travels to India & returns:
1. Returns Before Oct 2019 - Can she re-enter on her L2 visa and will her status change to H-1B automatically in Oct 2019?
2. Returns After Oct 2019, will she necessarily have to go to a US Consulate there for a visa interview & stamping? If she is denied at the visa interview, will she at least be able to return to the US on her L2 and resume work at her company on her EAD?
