H4 visa

I cam to the USA under F1 visa and now working under H1 visa.My visa has not yet stamped under H1 visa.
1 Can i apply visa for my son under h4 though my visa is not stamped under H1.

2.I haven't submitted Income tax returns after i started working.Only submiited It returns when i was a student.Is that ok

Provide all proof of having maintained status in the US alongwith all proof of receiving an income cosistent with the LCA. Provide letters confirming employment from employer, also brief the H4 applicant on the situation so that he/she is able to answer all questions relevantly.
