God......................please help me ,Need F1 to H1 help

Hi,

I got my H1 Approved 2006 04 30 and Starts on Oct 1,and taking Master program, but my school advisor put me as out status because I drop the class, and now makes me cannot continue my study and I have trouble with my Status.

Now I am out of status on F1 as July 2006,but my H1 is approved (not consulate type)and i am not plan to leave USA, can I just stay until OCT 1st?
or do i need to do something? My friendn told me once H1 is approved and if I not plan to leave the country, then my status is fine because Oct 1 will change to H1, is that true?

Do I need to go to Canada to get H1 Visa if the Out of status is going to kill me?
I am not planning to leave USA and do I need to go to interview with IMMI officer to put me back to staus before the OCT 1 H1 ?

Was your H-1B processed as a chnage of status request? Do you have an I-94 at the bottom of the approval notice?

When did your school designate you as out of status?

Regarding ur question, As far I know, If yours is a change of status petition you could stay 60 days after ur opt to change status. I think u should talk to an attorney to check ur options.

Could please you tell us if urs was a premium processing, and which processing centre was it approved and what was your receipt date. It will help us guess processing times.

If your H-1B approval notice does not have an I-94, you will need to leave the US to obtain an H-1B visa. You should consult with an attorney based on your F-1 out of status issue. That may force you to go back home.
