URGENT HELP: L2-EAD to H1B Transfer woth COS.. Tricky question

Hello,

I am presently working on L2 EAD for company "X".

I have a H1B petition(non stamped) through company "Y" processed for FY05 quota.

I am joining a new employer "Z", I want do a H1B transfer with COS(Change of Status) by using Y's H1B Petition.

I spoke with a paralegal consultant and she told that it is possible to transfer this kind of case using a special clause.

Question 1) Are you aware of such circumstances. ?

Question 2) What is "nonfrivolous".?

You need to be in actual H1B status to get a H1B transfer filed and approved for you.

This case is L2 to H1 COS with H1B transfer.
