Question regarding 38 in DS 156

I am in the process of filling the DS 156 and would require guidance on item 38.

I went on academic probation right before my graduation and had to apply for reinstatement. I was reinstated and proceeded to graduate with my MS.

I was also arrested for Operating while intoxicated and went through the probation program. I have completed it and have valid documents to support my situation.

Now for the questions in item 38

first question - Have you been arrested or convicted of a crime.....
fourth question-Have your ever violated..............

What should I enter in the fields - Yes/ No

Please guide me on this

IMHO -- Better select "Yes" and provide all the paperwork related to the issue, along with the form.

As far as INS is concerned, and when you are not hiding something, better to be proactive.

I had to reinstate my F1 as well and I have answered "no" to 4th question since the VISA was reinstated after a couple of months. If you are reinstated you did not loose your valid F1 status. It was decided that you are not in violation of F1 VISA status and that is why you were reinstated.
