if both the spouses are in h1 b , then can they apply for a mutual consent divorce in US ? If so what is the procedure?

Is it also necessary to get a divorce from India also. If yes , then what is the procedure?

can somebody pls reply as this is very urgent .

if ur married in INDIA then u need to file divorce in india court....US wont have any juridication on that....
The case has to file in india and get legel seperation cert for that.

Divorce procedure in india is:

1- File a seleration app in marriage court.
2- This app has to file in that marriage court where the bride use to live before marriage. (means if bride use to line in Pune and went to b'bay after marriage then u need to file case in Pune court)
3- wait for 6 months....for the case to put up in marriage court, in between u need to goto the court to meet the counceller, so that they can check what is the actual prob and they can take final decision.
4- If u want to avoid step 3 then file a case with mutual concent. saying that both of u dont want to stay together and want to seperate ASAP. Then u will get the divorce in 3 months and u dont have to visit the counceller several time.

I have seen your post. It is not necessary that you need to get divorce from India Court. If you are getting it from U.S. it is valid in India also. So apply for divorce in U.S. only, as it is very easy in U.S.A.

Different states in US has different rules about how long either one of you need to be a resident of that state before you can apply for a divorce from that state.

But a divorce from US is valid everywhere. You do not need to go to India.
