  • H1 transfer qstn..URGENT

    Hi

I was working for company A and recently I have changed my employer and have started working for company B. I have a valid visa from company A till October 2007. And company B has applied for H1 transfer for which I am expecting the approval by the end of September 2006. I am planning to visit India in January 2007. My questions are:

    a. do I need to go for stamping in India based on my new I797 (for company B). If not, will I have any issues at PoE?

    b. When I go to India do I have to surrender my I94 stub that I receive along with my new I797?

Please advise and share any bitter experiences in such cases so that I can take care accordingly.

    Thanks

---- If you have a valid visa and transferred jobs within this period at the POE show your new I-797 and valid visa stampon your Passport, get a new I-94 till the validity period of your new I-797 and you should be good to enter US

    b. When I go to India do I have to surrender my I94 stub that I receive along with my new I797?

---- Yes, submit one portion of your I-94 at the airline counter where you check in and keep one portion for your records
