Hi Friends,

I have one issue,
Can we apply H1B and L1 visa at a same time?
can we have both visa active?

I am working in India.
My H1B is filed by one of the consultant in US, it is under process, i have not received the papers from them to attend Visa interview with consulate.
Now my present employer in India is applying for L1 visa.
Is it going to effect my H1B processing?

Which visa(H1B or L1) is better?

Hello there,
I am not sure if what you mean by yout contractor applied for H1 VISA but ambassy not replied yet, are you saying that you have already received H1 VISA papers and went to Ambassy to get stamped? or at least took on interview appoinement with ambassy people? if not you got nothing to afraid of. Ambassy has no way of knwoing who applied for what VISA and how many ppl applied for you and its not illegal to have more than one VISA appied. how ever you can only validate I.e. get stamped in US ambassy one VISA. So incase if you already took interview appoinemnt for H1 stamping at US ambassy in India and now your company is takeing another date with US ambassy for L1 interview they can ( what i mean by they is your comapny) findout about your H1, because of your passportnumber. right now in the ambassy at a time on one passport only one appointment is given.
so if your VISA states are at stage where both of them are just applying then your are more than fine, and also if you have your H1 VISA in your hand and taken any appoinment with ambassy "yet" then also you r fine.

Thanks for your quick response,

One more clarification needed,
I have not yet received my H1B papers from US-consultant, but i have taken consulate interview appointment in Feb07, expecting petition papers by that time.

Now my Present working company promising me for L1, in this case can i cancel my H1B appointment and carry on with my L1 processing.

What is the validity of H1B petition if i do not attend interview for it?
so that I can get it stamped when i come back from L1 visa.

One more thing--
Is it the same H1B petition can be renewed for next year ?
in case if I did not turn from my L1 to India back within time.
