    Hello,
    I got my H-1 b visa transferred and I have the stamp for H-1b on my passport valid upto 2008. But this stamp is on my previous employer name. My H-1 transfer is already approved and currently I am working with the new employer. Kindly tell me if I go to India now do I have to again get my H-1 stamped as i have a new employer now and do I need the new I-94.

    ---- Generally, you do not need to apply for a Visa as you already have an unexpired Visa on your Passport (even if it is due to a previous employer). You can return back to US on the same valid and unexpired Visa on your Passport and you will be given a new I-94 valid till the validity date of the I-797 from your new employer

    ---- In summary you do not have to go for getting a Visa due to your new employer. However, if you prefer you should seek legal counsel in the case so as to be fully confident of your approach
