  • Passport Expiry and H1B Extension

    I am currently in the US on H1-B visa(7th year extension). My current H1B petition is valid from April,06 to April, 07.

    I am planning to apply for 8th year extension. However, my passport expires in Oct, 07. Can I apply for a 8th year extension with my current passport ? Will they extend my stay till April, 08 or only till the validity of my passport ? That is, will they approve the I-797 till April, 08 or Oct, 07 ? Will the I-94 at the bottom of the I-797 be till April,08 or Oct, 07 ?

    I think, If you have a 6-months valid passport, you will get the H1B extension !

    When should you apply for the new passport ?
    Within one year of expiry of your passport. For example if your passport is expiring on 31st Oct 2007, you can apply for a new one anytime starting from 30th Oct 2006.


    First apply for a new passport & then apply for H1B Extension as you still have enough time.
    Check it out for an expedite process at the nearest Indian consulate !
