H1 Extension/Expiration

Hi All,

My situation is that my first 3 years H1B expires on Jan 5th, and I have applied for an extension through my employer at California Service Center. The status of the application is still "Pending".
I am wondering, if the extension is not approved till Jan 5th, what would be my status? Would it be OK to continue working? Would I have to wait until my extension approval, to start work again?

Hi All,

This is what I found out from my attorney:

As long as the H1 extension was applied before the expiration date, even though the extension is not approved, employee can work with no issues.
However, travelling during the H1 extension process would be the on employee's own risk.
