  • H1 - H4 - H1

    Hello Seniors and other members,

I have a question regarding H1 to H4 transfer and then again H1 transfer.

My wife is currently on an H1B visa (through a consultant) and she wants to switch back to H4 (I am an H1B visa holder myself) for a short period of time..

My question is can she transfer her H4 to H1B when she wants or will she have to file for a new H1 under the 65000 quota again..

Your suggestions and answers are greatly appreciated.

    Thanks
    Rajesh

She needs apply for new H1B. If this H1B is from a nonprofitable organization, don't worry about anything as there is no cap of H1B for a nonprofitable one.

If it is from a profitable one such as a company, and her current one is also from a profitable one, don't worry about the quote as she doesn't need new quotation.
However, if the current H1B is from a nonprofitable one, new quotation is needed.
