H4-H1,visit to India,URGENT..

I am currently staying in USA on H4 Visa.I'am going to apply H1 by the end Month march 2007.Now i have a query regarding my trip to India.I have to go to India in the mid of April or first week of May.
So is there any legal complications involved for my trip to India for a period of 1-2 months during my H1 Visa filling.

If your H1 gets approved while you are in India, then you need to go for H1 stamping in India before flying back.
