  • Help needed regarding H4 visa

    Hi Friends,

    I just got my h1b revalidated at the New Delhi consulate and am traveling back for the US on 8th May. However, my wife is supposed to appear for her h4 visa interview on the 10th May. As per the required document list for H4 visa interview, the candidate is supposed to carry the I-797 of the principal applicant in ORIGINAL.

    I would like to know the following :

    1) do they ask for the original I-797 at the point of entry in US when one has a valid H1b visa already stamped on the passport? If yes, then I can leave the original I-797 behind with my wife for her H4 visa interview.

    2) can the visa officer at the embassy reject the H4 visa application if my wife carries a COPY of my I-797 approval?

    Would appreciate an early response. Thanks in advance.

    Hi,

    I am also in the same situation.

    Mine is more complicated as I am in US and my wife is going for her H4 stamping on 10th May.

    If I have to send the original I-797 then I have to do that today itself.

    Seniors please guide me on this.

      As per the new guidelines you have to submit the new I-797 form of the principal applicant

        So if I leave the ORIGINAL I-797 with my wife for her interview, will they let me enter the US with just the current & valid stamped visa on my passport??

        Is there any link on USCIS site where they mention what are the mandatory documents one needs to carry while re-entering US?

          You do need to carry the original I-797 with you at the POE.

          You can probably get a copy of the I-797 notorized in US and send it for your H4 visa interview
