L1 to H1 - CHANGE OF STATUS

I'm on L1 with company A for last 3 years. Company B applied for COS to H1, its still not approved yet. If COS is approved with a start date of oct 1, can i work for another 2 months with company A itself? my plan is to go to India during December and get H1 stamped (thru company B) and then come back here and start working for company B.

Do you see any thing illegal or wrong this way? Please advise.

I've heard of many people continuing on L1 even 6-7 months after the H1 validity start date. are they all illegally working then?
