h1b approved - company not interested

hi friends,

my H1B petition got approved this august i.e in aug 2007, but after visa stamping, now my company is not looking interested in sending me to USA for the project..

so my question is can i switch my company in india without losing status of H1B visa.

Hi you cant get the same VISA .If you change the company then they will cancel the VISA . You have to travel at least 3months with that VISA from your company if you want to transfer it.Otherwise its not possible.

There is only a little bit of truth in what "RforRaj" said.

Your case will not be transfer the way it happens when you switch jobs while in USA.

In your case another company will have to file for H1 mentioning that you are cap-expemt as you have been counted towards cap once. You will have to wait for this H1 to be approved before you can travel to USA to work for this employer.
