H4 to H1 COS Issue,It's Urgent Plz Respond

Hello All,

Here small query about my wife Entry .She got her H4Visa on March-26-07 and never entered USA.
Her H1 is filed in Apr'07(Not Including COS),Not yet Approved.she is planning to come here in Feb'08.

1)Is it Mandatory to Enter USA on H4 before October 1'st and Can apply for COS/Amendment for H1(Heard that if she enters after Oct'1st on h4 her H1 will be Cancelled)

2)When we need to apply for Cos(Change of Status).

3)What is the best way to get her H1 Visa.

Appreciate ur advice.

her best course would be to wait for her approval and get H1 stamped and enter using that.
that will avoid all complications
and if you think that i did not answer your first question, just cause she had a visa stamped does not require her to use that first before getting another one.
