L2 to H4 transfer

Hi, I have applied for L1 VISA and currently working in USA and my dependants are with me on L2 VISA. I have applied for H1 VISA for the same petition and currently have the petition. While applying I have not applied for L1 to H1 conversion. So I can’t convert it in USA. So I am going to India for H1 VISA stamping. I am planning not to take my wife and daughter with me as they have valid I-94. Does their status automatically get converted to H4 once I stamp my H1? If not, whether it is possible to convert their VISA from US after getting my VISA stamped without making them to travel? Your response is appreciated.

They need to get H4 visa stamped before they can travel back to US.



When you apply for H1 for you, you should apply for their H4 visa as well.

Hi,
They are currently at USA and with valid I-94. Is it ok for me to go alone and get my VISA stamped for me and my dependants stay here in USA and convert it once my H1 is stamped? Or do they need to go with me for stamping from L2 to H4?

You need to apply for their change of status from L2 to H4, in US.

Once they go to India, they need to get H4 stamped.
