H1 transfer denied! Subramanya please help!!!

Hi,

My husband has applied for H1 transfer within the first month of coming to USA , without pay stubs. He joined new employer as soon as he got receipt number. from past five months he is on a project and getting pay stubs regularly.

Now his H1 transfer is denied. Reason for denial is not known to us as of now...

What are the options with him now?
Can he apply another H1 transfer to new employer?
Can he go back to the previous employer?

---- He can apply for another transfer, but he has to be in H1 status and employed by a company or on H4

Can he go back to the previous employer?

---- If the previous employer has not cancelled or revoked the H1 petition, he can join them, provided they agree to take him back into their payrolls

Thanks for your response. can you please elaborate on what do you mean when you say he has to be in H1 status and employed by a company.

He is already working for the new employer who filed his h1 transfer, does this mean that he is in status.

Using this company;s receipt number/notice can he apply for another transfer.

his working with his new H1 employer is illegal now as it was denied, his H1 with Company A is still valid if they did not revoke it and he can work for them, while applying for transfer to another comapny.

The other option is to appeal the decision.
