  • H1B extension and H4 stamping

    I am working with employer A and got my H1B extension this year. I have to go for stamping whenever I travel India. I am getting married in Dec 07 and will come with my wife. I want to join employer B before I go to India. I have few questions in this case

    1.How much time it will take to receive the new approved I-797 at this time?

    2.I don’t want to screw-up my marriage plans so what is recommended, wait to come back to US and then change employer or its okay to change now?

    3.Is there any min pay-stubs count I need to carry for stamping of employer B?

    if you file premium processing then 15 days but will cost $1000 extra (but worth the risk)

    else transfer after you get back.

    There is no min paystub requirement, but it should be at least the number of months you actually worked for them, The whole idea of pay stub is to prove that you were in legal status all this time. That can be proved using a combination of A's pay stubs as well as B.
