  • 1st time Travel on H1b Issue.

    I just got my h1b stamped a couple of days back. My history is:
    F1->OPT->H1b

    I left for India as soon as my OPT expired and surrendered my I94 card. Soon within 2 days my H1b was approved and I got a NEW i94 card with it. My other friends did not get a new I94 card with the approval I797. Now is this an issue that I have a new I94 Card with me, even though I surrendered mine when I left the US. The new I 94 Card number is the same as the one that I surrendered.

    Also which documents will I need for Immigration? Do I need any additional paperwork from my employer? I dont have a definitive start date mentioned in my offer letter. I just says your employment starts as soon as you report to us.
    Please advice. Thanks

    All you need is the I-797 at the POE, it looks like they applied for H1B when you were in the US. Upon entry, you will get a new I-94 number - You will fill anew form I-94 on the plane (H1B entry), there is nothing to worry. You have left country in F1/OPT status and returning on H1B.

    Not a legal advise.
