  • H4 to H1- Mexico consulate

    Hi all,
    iam here in the US on H4. I have my H1 approved with Chennai consulate mentioned on I797. Can i get my H1 stamped from the US consulate at Nogales, Mexico.? This is my first H1.
    If i can, even if my H1 is rejected at Nogales, can i reenter the US on my H4, as i havent filed for an amendment on I94.

    It is not a big problem

    You can attend for visa in mexico or canada.Doesn't matter weather you are H4 to H1 or H1 to H1 stamping.Need to have a proper documentation.Many of them from H4 to H1 will take stamping in mexico or canada ,instead of taking risks in India.

      thanks for replying. but here the case is a little different. h1 got approved when i was in India, and hence I-797 does not have an approval for a change of status on I-94. i entered the US with H4 and my I 94 status reflects the same.
      When the I-797 has a consulate/POE (port of entry) as chennai, my understanding (from forums) is that the details can be pulled only by a consulate withing jurisdiction of approval. ie, if you go to canada or mexico with POE as Chennai on I -797, these consulates may not be in a position to validate your documents. Is this true?
