  • An important question

    Hi.

I have a query regarding H1B visa. I've been sponsored by my husband who is a U.S. Green Card Holder and had gone to U.S. on immigration before my marriage.

A source from U.S. Embassy has told me that I cannot apply for U.S. Non-immigration visa since I've already been sponsored. But I'm an I.T. professional and have been working as a Database Developer/DBA for last 8 years. I've got an offer from a U.S. based company. Now my question is, can I or that company apply for my H1B visa??

Can you please reply me ASAP so that this confusion can be removed?

    Thanks,

You can certainly apply for H1 because H1 is dual intent. What you can't apply is something like tourist visa, student visa.
