Hope you are doing fine! We are facing a problem here and need your
advise on this.
My wife is working on a H1B Visa on a project in USA with JP Morgan.
We are coming to India for a vactaion and we are planning to her H1
stamped in the 2nd week of December' 2007. She has misplaced or lost
the original I-797. She has original I-94 and a photo copy of the
I-797. We have searched for her original I-797 everywhere but can't
find it. Also, we plan on applying for a duplicate I-797 tomorrow but
we are not sure of how long does it take to arrive as we do not have
much time on hand.
She has SSN (Social Security Number) and she cannot work in USA
without a SSN as you must be aware. The SSN cannot be issued without
showing the original I-797. Therefore we have my wife's SSN as the
proof of her possessing I-797 earlier.
Pls. advise if the photo copy of I-797 with original lower part of
I-797 (Original I-94) and with original SSN Card will be sufficient
enough for her to get the H1B Visa stamped on her current passport.
