H1 to H4 and back?

My wife came to US on H4 visa. She applied for H1 through a consulting company in 06 and started working from Oct’06 through June’07. She has not been working since July’07 and now her employer wants to withdraw the H1.
According to the employer H1 can be reapplied for whenever she would like to start work back. And it would take just 2 weeks.
• Is this claim true? Can the H4 visa be reverted toH1 in two weeks?
• Would she not have to go through the allocation process?
• Does she have to reapply for h4?
• What is the process for that under such circumstances?

If your wife is not getting her pay check while she is in H1B status, that it self make her out of status.

She must go back to H4 (You must apply and change H1 to H4) as soon as possible. Whenever there is a job opportunities she can re apply h1 to work.

You can change h1 to h4 to h1 several times without any problem if you do it on time.
