    I am new to this form and most of the postings were really helpful.I would appreciare if you all could help me as I am in strange situation:-

    I and my wife went for H1 & H4 visa stamping in India, Since my wife was pregnent so she stayed back in India, Mean while I had issues with my current employer and I transferred from company A to B.

    Now I am planning to bring my wife and son to US :
    1.Since my wife has valid Visa(from company A) and never entered US, Does she have to go for visa interview as I moved from company A to B. Is her visa valid for travel.
    2.If I travel to India to bring my family, do I have to go for Visa interview?
    3.If I or (my wife & son) go for interview by Jan 2008, do I or my family need new I-94, W2 (My previous employer did not file it or may not file it for this year 2007)
    Please Help!!

    1. As per my knowledge i think she need not go for the interview again. Her visa will be valid for travel.

      ---- She can travel on the current Visa. However, she needs to carry a copy of your new I-797 to be shown at the POE to get a I-94 as per the validity of the new H1

      2.If I travel to India to bring my family, do I have to go for Visa interview?

      ---- No, if you you have a valid Visa at the time of reentry to US show your new I-797 for a I-94 based on its validity

      3.If I or (my wife & son) go for interview by Jan 2008, do I or my family need new I-94, W2 (My previous employer did not file it or may not file it for this year 2007)

      ---- I-94 is not needed at tthe time of interview. It is issued only when your enter US and it is submitted by you at the tome of departure. W2 has to be given to you irrespective of what happens. In fact it will come to you at your home address. What do you mean when you say the employer may not file this year (there is no such thing as not filing, if he has paid and the taexes deducted from your pay)
