In the DS 156 for question 36...

36)Has any one filed a immigration petition
on your behalf?
I have checked NO.

Correct me if am wrong. My employer has filed my H1 and I will be going for the visa interview. This is a non-immigrant petition ..is this correct? Hence I have checked NO or should I check "Yes" and give the employer info?
My understanding is, a immigration petition is if one wants to be in the US permanently but the H1 is a non-immigration petition and according to immigration terms, h1 is part-time employment for 3 years.

Admin,Subramanya and other experts kindly confirm this with me.

I just found out if you have applied for GC or any permanent residency then you will have to say Yes and mention the employer's name.

If you have filed only for H1, you will have to say No.
H1 is a non-immigrant petition as it is for 3 years and from immigration's point of view it is temporary work.
