  • FY05 quota

    As of Aug 4th there were 40,000 H1B cases filed against FY05 quota (65,000). Does someone know how many H1B’s are available at this point? A friend of mine claims that FY05 quota is over as of last week.

    The posts on lawyer sites I have seen indicate that there are about 58K H1 visas available. 40K applicatons have been filed.
    The quota therefore is not yet filled, but it is getting close.
    From one lawyer:
    "Released just today, the most recent information regarding the H1B cap is that, as of August 4, 2004, 40,000 cases had been filed against the fiscal year (FY) 2005 cap. [...] the total H1B cap for FY2005 is 65,000. Some of those numbers are reserved for nationals of Chile and Singapore, however, due to certain Free Trade Agreements (FTAs) signed by each of these countries with the United States. Thus, there actually are only 58,200 H1B cap numbers available for each fiscal year. (Some of the Singapore / Chile numbers may get added back in after October 1, but the number is not known at this time, though there are not supposed to be very many that were used under the FTAs.)"
