H1B Extension - Approve or Not?

Hi! I just would like to know if my wife can still apply for a 7th year H1B extension having the ff scenario:

1. Initial Labor Cert Application under RIR filed last November 2003 but the case is closed.
2. New LCA under PERM is filed last August 2007.
3. My wife enters US in October 2002.
4. H1B Visa expires on April 2008.

Please let us know. WE badly need your help. Thanks

H1 expires April 2008
Since she enters Oct 2002, 6th year will be OCt 2008. Why the short fall? If you provide any evidence for the short fall of 6 months, you can renew your H1 first to Oct 2008. If you are successful you can extend your h1 7th year based on Aug 2007 PERM.

We have an agency who is working on it. However, as of this date, we haven't heard any update from them. Their silence bothers us a lot. Bytheway, can't we use the first application of Labor Certification, even if its closed already?

You do not need an agency to figure it out. First do your math, then instruct your agency to follow it.
Agency do not care about your frustration they care only your money.

With a close out LC, you can not build anything on it.
