Earliest date to start on a H1b visa ?

I have heard from an immigration attorney that the earliest date to start was October 2008.

I thought it was April 2008. Anybody has any information regarding this ?

you apply for it in April
if it is granted, the H-1B's earliest beginning date is Oct 1st
unless you are elegible for a non-capped (no quotta) H-1B
essentially, if the employer that'd be sponsoring you is in the private sector, your visa is subject to the cap number and you need to apply in Apr
