  • what is cap-exempt [NON-PROFIT] H-1B visa ??

Hi.. can anyone tell me what is cap-exempt [NON-PROFIT] H-1B visa ??
Secondly can an H4 visa try for this visa type, if so how is the process [whether he/she has to go through consultants or can aproach the non-profit company/organization or the university in person..]??
thirdly what are the pros & cons of this type of visa and can the person change from a non- profit co. to a profit oriented co. after some time or if he/she gets a better offer..??
    Thanks in advance !!!

Most of the universities, health care organizations, school districts etc qualify for non profit org and non cap H1.

First you have to get a job offer. Any one can try job irrespective of their current immigration status.

Universities and NGO's(Non profit organizations) are CAP exempt.
You can search for jobs directly..no need of any consultant.i dont see a problem in changing from h4 to H1.
highered jobs is a good site for jobs in universities. You will have to simply get in touch with NGO's through their website or directly and look for opportunities.

If you get a better offer in a profit making organization, you will have to apply as a new candidate again for H1 since you were exempt. You cannot do a transfer from CAP-exempt to NON cap exempt.

On the other hand if you get an offer from another university or NGO,you can do the transfer with no issues.

H1 processing is usually fast for universities.

Note that this is not a legal advice. Consult your immigration attorney for the best upto-date information.
