H4 visa - travel issue - Urgent advice needed

My wife has a valid h4 stamping till Dec 2008 from my previous employer. I changed my employer, H1B transfer and I539 for my wife was filled on Oct 4 at VSC. My case is still pending.

1. My wife has to go to India for a family emergency. Can she travel outside of u.s while the case is pending ?

2. Can she travel back to u.s with previous employer H4 visa ?

3. If H1B transfer is approved, does she need to do new stamping for H4 ?

4. If new stamping is not required, can she request the immigration officer at the port of entry to issue the new I94 validity till end date of new approved petition which will be Feb 2009 ?

Your spouse can travel with alid h4 visa stamped in her pass port as long as your H1 status is valid irrespective of your sponser.

Unless her H4 gets renewed separately, her present validity in the passport only reflect in her I 94.

I got approval for H1 and my wife's H4 transfer from my new employer yesterday. She has a valid stamping till Dec.2008 but for the new H4 the extension is till Feb 2009. We are going to India On Feb 08, I need to get stamping because mine is expired.

1) Do I need to book visa appointment for my wife or she can travel with the old stamping?

2) Can she request the immigration officer to provide new I-94 valid till Feb 2009?
