  • H4 to H1 - Please help

    My wife came to US on H4 in March 2007 and applied for H1 in April 2007. She is selected in the lottery for H1 in 2007. She did not get an approval yet as there is a query.

    She is planning to travel to India for around 4 weeks.

    Can she come back on H4 visa to US if her H1 gets approved while she is in India?
    Can she start working without going for H1 visa in case her h1 gets approved while she is in Inida?
    Can she start working without going for H1 visa in case her H1 gets approved after she returns to US on H4?

    Please answer ASAP.

    H4 interview tips

    Hi, I have questions regarding H4 interview. My spouse is going to attend the H4 inteview in India, in Feb 08. My question is, does my spouse need all the original documents of mine? like the I797 etc., Also, are there any chances of visa rejection based on the following:
    if my spouse is a IT professional with more than 3 years of experience (will they consider this as a potential immigrant case?)
    Also, I earn close to 40K/annum, so will it be a problem? Do I need to show any bank balance? If so how much???

      If you earn less then your H1 LCA then it is a problem.
