  • Less pay on W-2 as compared to in offer letter.

I have changed my visa from F1-H1.And since then I haven't got my passport stamped for H1 visa.I am planning to go to India this Aug2004 to get my passport stamped.I have a question regarding my W-2. I didn’t get paid as stated in my offer letter($55K). My pay is less than what should I have got ($14k), but we had some perks like accommodation, transportation and groceries.

If I am asked for the difference in my pay at the consulate Is there any way I can defend it.

    Any replies greatly appreciated...

You can't get paid less than what the LCA stated.
What's the reason for the low pay? Benching without pay? That would be illegal, and would mean that you were/are out of status.
