Hi
My experience tells that most of the experienced guys, either by profession or by US stay, will prefer to work as Independent consultants.
What I mean, these consultants will find the Job on their own and will pay their H1b visa sponsor a part of their earnings, ranging from 10% to 30%. The below proposal might also work for employees of Desi Big 5 companies, who sweat day and night to meet targets and are paid a mere salary compare to those with US Citizens or GC holders.
As this being the election year in US and Immigration forming a core issue for debate, is it good approach respective party nominees with a proposal that : All those persons who have been working in US for more than 36 months be given EAD's or be given authorization to work as independent consultants based on the following conditions:
- Education
- Their employment history in US (Work Hours per Year, Prior Client's references)
- Filing of taxes regularly (Last 3yrs Tax returns)
- Tax Contributions to Govt (SSA, Medicare, State, County / City Taxes.. When summed up to exceed a min of $20000 per annum)
- Security (Driving history, Any abuses reported by Law Agencies etc.,)
- Individual Skill Set and need for their services to US Market (This is the pivotal reason of Desi Body shoppers to convince INS for H1's)
I know that the folks getting benefit from this proposal will not have any voting rights and there might be a chance that this proposal be given a cold shoulder, but I feel it is worth trying to push the proposal at least as an item for debated
Supporters:
- Companies / End Clients who gets benefited a lot, as their operations cost will be reduced;
As such a consultant will propose for less rate for the services than a body shopping firm , which eliminates the middle man
- Insurance companies
They can charge higher health insurance premiums to individuals, as they are not covered by any group plans
Liability Insurance firms will have good revenue, as all the consultants will apply for liability insurance
- Retailers
Individuals will spend more as they earn more (basic law of economics)
Opponents
- Body Shoppers (Blood suckers)
They will not have experienced lot with them.. Only people who are just shipped out of college
- Desi Big 5
Their on site offshore model's will definitely take a beating as experienced folks move out
Please post your responses and then if needed we can have a get together to arrive at team composition and plans to move the proposal. I highly appreciate if any immigration lawyer post their comments.
