India trip from April'08-May'08 but my visa is Exp in Sep'08. What should I do?

Hi,

I have to visit India from April 2008-May 2008, but my visa is expiring in September 2008. So

1) Do I need to get my re-stamping done before I go to India?
2) Do I need to get my re-stamping done in India?
3) I can file the visa extension after I come back from India?

When is your work petition approval notice (I-797) expiring?

VISA expiration date = date up to which you can come back to the US
Petition Approval Notice expiration date = date up to which you can legally work in the US

So, if your approval notice also expires by Sep 2008, better ask your employer to file for renewal petition, and once you get renewal, then go to India and get restamped.

You can go and come back without any problem. I went to India recently in Nov 07 and came back on 30th Nov. My stamped visa was expiring on Jan 10th 2008. At the port of entry I was asked if my H1 renewal has been filed and I said yes. That's it. Since you have almost 4 months before your stamping expires, you will have absolutely no problem.

I just returned from India on 20thJan08. My work authorization expires on 1april08 (I-94 date). The officer at POE asked me for my I-797 (i had copy and it was sufficient). He also said that its strange my VISA is expiring in just 78 days and whether an extension has been filed or not. I said yes my company is filing for extension. I was granted entry.
