I have following question regarding Visa transfer. I could not find the find answer from FAQ section so I am sending my question. It would be great if you reply to my email. Thanks in advance.
"I came to US on H1 from Company A. My Visa is valid till May 2008.
In March 2007 I found a new employer, B and he filed H1 status transfer for me. I received the receipt of H1 filing and I started working for new employer. USCIS has sent a query for additional documents.
This company B is a startup company so now I am worried about my transfer approval. Now for some reason if H1 transfer is not approved by USCIS then after that can I file H1 transfer from another company C ? Or if the transfer is not approved then my status becomes illegal ?
Or can I stay in US based on company A's Visa ? In that case I won't have pay stub from company A for month of April 07 and May07 but I will have pay stubs from Company B for those months. Will those pay stubs valid for Visa transfer from A to C ?
Or If I am doubtful about this transfer approval then shall I file a transfer through company C as a backup right now itself ? But in this case I won't have pay stub from company A for the period of April as I have already left that company."
